Estate Litigation

Anderson, Johnson, Lawrence & Butler, L.L.P. handles a limited amount of Estate work on the planning side, such as basic wills, trusts, and powers of attorney. The larger portion of the firm's work as it relates to estates is in situations where there is a claim that is brought either against an estate on behalf of an estate, or arising from a dispute among heirs to an estate. Our firm has considerable experience in representing parties in will caveat cases, in which the validity of a Will is challenged, as well as disputes that may arise during the handling and probate of an estate in which various heirs find themselves in a position of conflict requiring individual representation.

Typical Estate Law Litigation Matters

The following is a list of areas in which the firm has previously represented heirs and parties in estate matters:

  • Disputes involving executors, trustees and fiduciaries
  • Partition of property and assets
  • Power of attorney disputes
  • Litigation involving a trust or the termination of a trust
  • Will contests (caveat)
  • Guardianship and conservatorship litigation
  • Misappropriation of funds and other breaches of fiduciary duty
